 These terms and conditions (“Terms”) apply to all orders for products sold on our website (“Products”). By ordering Products through our website, you are deemed to have understood and accepted these Terms.

We may amend these Terms from time to time. Every time you wish to order Products, please read these Terms to ensure you understand the terms which will apply at that time. We recommend you print a copy of these Terms or save them to your computer for future reference.

This website, Sorelleuk.com, is operated by Sorelle UK Brand Limited (“we” or “us”), a company registered in England and Wales under company number 10490675. Our registered office is at Unit 3 Nutwood Trading Estate, Limestone Cottage Lane, Sheffield, South Yorkshire, United Kingdom, S6 1NJ.

This website is intended for consumers. If you are a business customer, please contact us.

Contract of Sale

The shopping pages on our website will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order.

Please take the time to check the details of your order at each stage of the order process and before clicking “Pay Now” (or equivalent confirmation button), as you will not be able to make any changes to your order after this point.

After you place an order, you will receive an email from us acknowledging that we have received your order. This email does not constitute acceptance of your order. Acceptance of your order will only take place when we send you a second email that confirms that the Products have been despatched (“Despatch Confirmation”), at which point a contract will come into existence between you and us.

Please note that Products are subject to availability. As there is a delay between the time when the order is placed and the time when the order is processed, the stock position relating to particular Products may change. If a Product becomes out of stock we will notify you as soon as possible and you will be refunded the amount paid for such Product if we have already taken payment.

We reserve the right to refuse an order for example if the Product you have ordered is unavailable or out of stock; if we are unable to obtain payment from you; if there is an error, inaccuracy or omission in the description or price of the Product you have ordered, or an offer or promotion redeemed by you; or if we suspect fraudulent activity. If we are unable to supply you with a Product in these circumstances we will inform you of this by email. If you have already paid for the Product, we will refund you the full amount, including any delivery costs as soon as possible.

 

Products

The images of the Products on our website are for illustrative purposes only. Although we take all reasonable care to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. The Products you receive may vary slightly from those images.

All sizes and measurements of Products are approximate, however we do take all reasonable care to ensure they are correct.

Please be aware some colours from fabrics may run or transfer. We recommend you take care when wearing our Products and follow all washing and care instructions which can be found on the care label attached to our Products.

If we offer free of charge items when you buy products from our website as part of a promotion (“Free Gifts”), such items are subject to availability. If a Free Gift becomes out of stock we will notify you before dispatch of your order and you may cancel your order.

Price

We take all reasonable care to ensure that the prices of Products on our website are correct. However, it is always possible that, despite our best efforts, some of the Products we sell may be incorrectly priced. If, before dispatch of a Product, we discover that the Product’s correct price at the date of your order is higher than the price stated on our website when you placed your order, we will contact you as soon as possible to inform you of this error, cancel your order and issue a refund of the full amount you paid for the order, and invite you to place a new order for the Product based on the correct price. If we accept and process your order where such a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any Products provided to you.

The price of the Products may change from time to time without notice. However, these changes will not affect orders that have already been accepted by us.

The price of a Product includes VAT (or similar sales tax) (where applicable) at the prevailing rate for which we are responsible as a seller.

Please note that the prices listed on our website are only applicable for Products purchased via our website and not through any other source.

The price of a Product does not include delivery  charges, which will be payable in addition. The amount of the delivery charge will depend on delivery option you have chosen at checkout. Details of the delivery options and charges are available on the “Delivery Information” page on our website and are set out during the checkout process.

Please note that where you order Products for delivery to a destination outside of the UK, you may also be required by your country of residence to pay import duties and taxes (in addition to the price of the Products and the delivery charges). Please contact your local customs office for further information so that you are sure about the applicable duties and taxes before you place your order. We are not responsible for payment of such duties and taxes and in the event that you refuse to pay such duties and taxes the order may be disposed of or in some cases returned to us. If the order is returned to us, we will require you to pay any costs that we have incurred as a consequence.

Payment

We accept payment using any of the payment options made available during the checkout process. If you pay for Products on our website using one of our buy now pay later providers, your payment will be subject to additional terms and conditions between you and the buy now pay later provider. Information relating to, and the terms and conditions for, our current buy now pay later providers can be found here: Klarna, Laybuy, Clearpay.

We take payment for the Products ordered by you, from your chosen payment method at the time your order is placed.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified as soon as possible. You will own the Products ordered by you once we have received payment in full.

Delivery

You must provide us with complete and accurate delivery address information. For the avoidance of doubt, this includes not only the address that your order is going to but also the name of the recipient. We cannot be liable for delivery of your order to the wrong address or the wrong person as a result of you supplying us with incomplete or inaccurate information.

We will use all reasonable efforts to deliver your order within the estimated timescales provided on our website. However, delays may occur due to events outside our control or unforeseen factors, for example, material shortages, travel or transportation disruption, import delays, software or technical failures or higher than anticipated demand.

Please note, delivery of your order may take longer than usual during sale or other busy periods.

We are unable to deliver on public and bank holidays, Christmas Day, Boxing Day or New Year’s Day. On these dates, delivery will take longer than usual.

We reserve the right to deliver your order to you in instalments.

Please note that where you have pre-ordered a Product at the same time as ordering other Products, all of the Products will be dispatched at the same time once the pre-ordered Product is ready for dispatch.

Please note that if you place an order for Products which are not currently in stock but are available to pre-order, such Products may take between 4-12 weeks to come into stock. Your order will then be dispatched with your chosen delivery method

Disputed Deliveries

If you bring a claim that the Products you ordered have not been delivered to you, we reserve the right not to issue a refund to you if we have proof of delivery from the courier i.e. GPS tracking, customer signature, photographic evidence, or if you have identified a safe space/neighbours to take delivery for you and we have proof of delivery to such place.

If you have used one of the third party payment providers available on our website and you bring a claim for non-delivery and such third party determines that your claim is unsuccessful because there is evidence that your order has been delivered to you, we may still be charged a fee by the third party payment provider for processing your claim and we may recover that fee from you.

Where we reasonably suspect fraudulent activity, including, but not limited to, circumstances where there are suspicious claims relating to orders that have been placed and 'not received', or if we reasonably suspect that you are returning items after they have been used or worn, or items returned do not match what you ordered, we reserve the right to withhold funds and to block your account (and any associated accounts) from placing orders in the future. If this is happens to you and you think we have made a mistake, please contact us and we will discuss this matter with you further.

Can I make Changes To My Order?

Once your order has been accepted by us you will not be able to make any changes to the order. You may return the ordered Products to us because you have changed your mind or because the Products are faulty in accordance with the terms set out below.

Returns where the Product is faulty

We are under a legal duty to supply products that are in conformity with the contract and these Terms.

Returns where you have changed your mind

You have a legal right to cancel your contract if you change your mind within 14 days after you receive the Products. If you exercise your right to cancel your contract, we will refund the price you paid for the Products, including the cost you paid for the delivery of the Products (subject to a maximum refund of delivery costs as set out in our Returns Policy). 

We also offer an extended returns policy to all customers, if you have changed your mind. If you return the Products to us after the 14 days returns period but within 28 days after you receive the Products, and we will issue Store Credit in the amount equivalent to the price you paid for the Products, but not including the cost you paid for the delivery of the Products.   

There are certain Products to which your right to cancel and our extended returns policy do not apply. Please refer to the Returns Policy on our website for more details, which can be found on our “How to Return” page.

If your return is rejected and sent back to you, do not then return it to us again as this will be disposed.

Unsanitary and unhygienic returns will also be disposed.

Discount Codes

You can only use one discount code per transaction. You can however use one discount code and one voucher code at the same time.

We may, at our discretion, exclude selected Products from discounts, such as pre-order and sale items.

Voucher codes are provided as either a Gift Certificate or as Credit for a returned item. 

Payment using a discount code or voucher code may be subject to additional terms and conditions or exclusions, as provided with such discount codes or voucher codes.

Other important terms

Nothing in these Terms shall affect your rights as a consumer under the applicable law in the jurisdiction in which you reside.

We may transfer our rights and obligations under any contract with you to another organisation. We will tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

The contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the provisions in these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining provisions will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

These Terms are governed by the law of England and Wales. This means a contract for the purchase of Products and any dispute or claim arising out of or in connection with it will be governed by the law of England and Wales, except that if you are not resident in England and Wales the laws of England and Wales shall apply only to the extent that they do not override any mandatory laws of the country in which you have your usual place of residence.

In respect of any dispute or claim relating to a contract, we each submit to the non-exclusive jurisdiction of the courts of England and Wales, but nothing in this clause shall limit your legal rights to bring an action or to require proceedings to take place in the country in which you have your usual place of residence. For example, if you live in Scotland you can bring legal proceedings in respect of your contract in either the Scottish or the English courts.
